PartyGaming and US Attorneys Settle

PartyGaming and the United States Department of Justice have reached an agreement which should end the recent persecution of PartyGaming by the Justice Department.
A Non-Prosecution Agreement has been signed between the two parties. By signing the agreement, PartyGaming have agreed to pay $105 million in order to ensure that they have a clean slate under United States law. PartyGaming have also signed a Statement of Facts which includes some obviously factual information, and some which is disputable.
Indisputably, PartyGaming allowed US residents to play in their online casino and poker sites before the introduction of the Unlawful Internet Gambling Enforcement Act (UIGEA) in 2006. As for the more disputable “facts” in the Statement of Facts document is PartyGaming “admitting” that payment transactions done during the stated time period were against US law. Seeing as it has been shown that the law was not clear at the time, it is unclear whether any law was actually transgressed.
From the side of the United States Department of Justice, they have agreed not to prosecute PartyGaming for any actions performed for the time period in question prior to the UIGEA.
PartyGaming’s CEO, Jim Ryan stated “It has been a long and complex process but we have reached an amicable solution with the USAO (United States Attorneys Offices) that makes commercial sense for our business and is in the best interests of shareholders.” This explains why PartyGaming, as a good business move, was prepared to sign the Statement of Facts as it is.
