English High Court Judge Preempts Any Kentucky Court Decisions

The English High Court has ruled that no matter what results the Kentucky trial for the online gambling domain name seizures brings, that Pocket Kings, operated by Safenames, from out of the United Kingdom, is not bound by the Kentucky Supreme Court’s Decision.

According to Judge Michael Furness’ ruling, he found that English law forbids a foreign government from enforcing a law in an area covered by English jurisdiction, when that law is either penal or governmental in its nature. The pre-emptive decision made by the English court was done in order to ensure that should the Kentucky Supreme Court rule in favor of the state of Kentucky, that the operations of the English company, Pocket Kings, will not be interrupted. Gambling domain names play a central part in the smooth operating of an online gambling operation.

Although it seems unlikely that the Kentucky Supreme Court will rule for the state of Kentucky, this pre-emptive English ruling will ensure that the seizure cannot take place outside of the borders of the United States. Those online gambling domain names that are registered outside of the United States will understand that they can clearly ignore any domain name seizure orders in this case.

Safenames released a statement regarding this issue: “We are glad to have provided assistance in the clarification and determination of the order’s unenforceability in the United Kingdom and effective nullification of the Kentucky Court Order.”

The verdict reached by the UK court is in line with opinions expressed by legal experts all over the world, including in the United States.
